Terms of Service

By commissioning me in any kind of way, you are agreeing to the terms of service below and the License Agreement.
Any statement is subject to change.

I. Copyright & Usage

ᯓ★ THE ARTIST (Me):

-I retain full rights to all commissioned works, including the right to display, reproduce, and promote them on my platforms or portfolios.-I do not claim ownership of your original characters or designs featured in the artwork.-I reserve the right to refuse any commission request for any reason, with or without explanation.-I may update or revise these terms at any time.

ᯓ★ THE CLIENT (You):

-Commissions are for personal use only, unless commercial rights are specifically purchased.-Acceptable personal uses include: profile pictures, icons, wallpapers, gifts, headers, or social media posts — with proper credit (@ereyla / @itsereyla / @tokki_b4e or a link to my page).-You may request a private commission if you do not wish for your piece to be publicly shared.-You are not permitted to profit from personal-use artwork, including: • Reselling or redistributing the file • Uploading to print-on-demand sites • Using for marketing, promotion, or commercial purposes-WIPs (work-in-progress images) such as sketches and progress shots: • Are for personal preview only • May not be traced, altered, edited, or sent to other artists-All commissioned content is strictly prohibited from use in: • NFTs, crypto, or blockchain-related projects • AI-generated or AI-training content • If unsure about any use, please ask for direct permission.

II. Payment

- Currency: USD- Method: PayPal invoices only- Full payment is required upfront before I begin your commission.- For totals over $200, payment plans (1–2 weeks) are available — the final files will be delivered after full payment is received.- Please wait for confirmation of your request before sending any payment.- These are non-commercial, personal use only. If you are interested in doing merchandise, you must pay 100% aditional regarding royalties/buying the rights.

III. Process & Delivery

- You must provide clear visual and written references. • Commissions based on unclear descriptions, messy sketches, or vague references may be declined.- Completion time: typically 14 days to 2 months, depending on complexity (it also depends on the time the client takes to respond).Workflow:
1. Rough Sketch Phase -Feedback and revisions are welcome here. Late or delayed changes will not be held for. 2. First Revision -After applying changes, I will present a refined sketch. Additional major changes at this stage may incur an extra fee. 3. Base Colors -One revision allowed to tweak color before the final rendering stage. 4. Final Render -Delivered in high-resolution .png format via email, Discord, or online download. -No PSD/CSP files will be provided. -A small watermark will be included.📝 Revision Policy: -Up to 3 free revisions total (1 per stage). -Revisions must stay within the scope of the original concept and reference materials. -Major changes or complete redos after sketch approval are not allowed. -Errors based on missing info in your reference or description are not my responsibility. -Errors on my part (e.g. missed visible character details) will be corrected at no cost.

IV. Adoptables

🔖 Commercial Rights (Auto-buy)
  - You may use my art and designs commercially only if you purchase via Auto-Buy (AB).
  - Credit to me is required on any platform where the design is used commercially (e.g., tag @ereyla / @itsereyla / @tokki_b4e or link to my profile).
  - I maintain the right to showcase my work in my portfolio or on social media, with credit to the current owner.
  - If you decide to resell the adoptable and HAVE my permission (specially raffles/giveaways), you must include:      • Credit to me as the original artist      • The previous owner(s)      • Notification to me of the new owner and the transfer🛒 PURCHASING   • Refunds are not available.   • Only bid if you're certain you'll pay.   • Once payment is made, you cannot alter your choice of adoptable.   • Be ready to pay if the person who disrupted your bet cannot cover it for some reason.   • After acquiring an adopt, it is not permissible to exchange it for another one in my gallery, even if they share the same price.💵 Payment Terms
   • All payments are processed via PayPal Invoice (USD only) — fees are already included in listed prices.   • Full payment is due within 24 hours of claiming or winning an adoptable.   • Failure to pay within this window will result in cancellation and blacklisting from future transactions.   • If you anticipate delays, please communicate with me — I’m open to working something out🧾Payment Plans (For Auto-Buy Only)
   • Payment plans are available only for Auto-Buy (AB) options priced at $150+.   • Plans are limited to 1–2 weeks for full payment.   • Upon agreement, I will send a separate invoice and begin the plan.   • The final files will be delivered after full payment is received.   • If the payment is not completed on time, any money sent will be considered a fee for holding the design, and I reserve the right to relist or reopen the auction.   • If problems arise, contact me promptly to discuss a solution — but note that refunds are not provided under any circumstances.⚠️Usage policy  - You may not resell the design for a higher price than what you originally paid unless additional commissioned or personal artwork is included in the sale.  - Even if you modify the design, you are still not permitted to increase the resale value based on your edits alone.  - You’re welcome to customize or redesign the character, but please do not alter or edit the original artwork I provided.  - Co-ownership is allowed, but I will not mediate any disputes between co-owners. It is entirely your responsibility to resolve any conflicts that may arise.

V. Refunds & Cancellations

-Refunds are available only for YCHs, regular commissions, and customized adoptables. -Deductions will apply based on: • Time invested • Files already sent • Line art or flat color work done -Canceled commissions may be repurposed or sold by me later.💸 Refund Policy: -Full refund: if canceled before work starts. -50% refund: if canceled during the sketch phase. -No refunds: •After sketch approval •After final delivery •Due to personal dissatisfaction or a change of mind (I provide previews to avoid this) -If I’m unable to complete the commission for any reason: •A full refund will be given •You may not use any part of the work-in-progress provided⚠ Please do NOT open a dispute. Refunds will be processed directly and may take up to 15–30 days depending on my commission load and ability to resell the canceled slot.

VI. Prohibited Actions

The following actions are strictly forbidden for both commissions and adoptables:🚫 Copying or tracing my artwork
🚫 Editing, cropping, or merging images
🚫 Removing my signature or watermark
🚫 Reselling, trading, or falsely claiming ownership
🚫 Falsely claiming authorship of the design
🚫 Uploading my work to other sites without permission
🚫 Stealing, reposting, or claiming someone else's characters or art as your own
🚫 Using artwork in illegal content
🚫 Claiming my designs or other clients’ OCs as your own

I may revise my terms of service in the future to incorporate any additional elements I deem necessary.
